1. Introduction & Acceptance of Terms

Welcome to Luma Brush ("we," "us," or "our"), operated by Luma Brush Medical Equipment Trading LLC, a company registered under the laws of the United Arab Emirates. These Terms and Conditions ("Terms") form a legally binding agreement governing your relationship with Luma Brush, including:

• Accessing and using our e-commerce store hosted on Shopify ("Website").

• Downloading, installing, and using the LumaBrush Mobile Application ("App").

• Purchasing hardware, smart toothbrushes, accessories, or software services.

By creating an account, browsing our Website, downloading the App, or making a purchase, you agree to be bound by these Terms in full. If you do not agree to these Terms, you must immediately cease using our Website, Services, and App. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the platform following any changes constitutes your absolute acceptance of the revised Terms.

Luma Brush Medical Equipment Trading LLC is fully registered, licensed, and authorized to trade within the territory of the United Arab Emirates.

3. Eligibility & Account Requirements

3.1 Age Requirement: You must be 18 years or older to independently create an account, register on our platform, or purchase products through our e-commerce channels.

3.2 Minor Usage & Guardianship: Our platform includes products and technical features specifically engineered for children's dental health monitoring (such as LumaBrush Kids products). Purchase and use of these tools for a minor must be performed exclusively by a parent or legal guardian, who accepts these Terms on behalf of the child and assumes full liability for the minor's interactions with the device and software.

3.3 Account Registration & Security: Users may register accounts using an email address, Apple ID, Google account, or Facebook credentials. You are entirely responsible for maintaining the confidentiality of your credentials and for all underlying account activity. You must notify us immediately at info@agenticdental.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts containing fraudulent, inaccurate, or outdated registration data.

4. Medical Equipment & AI Disclaimer

THE REPORTS, DIAGNOSTICS, AND ARTIFICIAL INTELLIGENCE VISUAL ANALYSIS PROVIDED BY THE APP AND HARDWARE ARE FOR INFORMATIONAL AND PERSONAL MONITORING PURPOSES ONLY.

4.1 Wellness Tool Classification: Our hardware items, premium electric toothbrushes equipped with intraoral camera technology, and accompanying application software are consumer wellness devices. They are not regulated medical devices and are not intended to diagnose, treat, cure, or prevent any dental, structural, or medical condition.

4.2 Professional Consultation: The App utilizes advanced computer vision and artificial intelligence to highlight dental indicators (such as plaque or calculus markers). These metrics are automated estimates and are subject to physical limitations, including teeth coverage, image blur, lighting, and device positioning. They do not constitute clinical medical advice, diagnosis, or treatment. You must never rely on the App's outputs as a substitute for professional clinical examination, diagnosis, or structural intervention by a registered dental practitioner.

5. E-Commerce & Shopify Store Terms (Website Specific)

5.1 Pricing and Currency: Prices across the Website are strictly displayed in USD and may be altered dynamically without prior notice. For international shipments outside the United Arab Emirates, local import duties, value-added taxes (VAT), customs clearance handling fees, or goods and services taxes (GST) may be levied by the destination country and remain the sole financial responsibility of the customer.

5.2 Gateway Transactions: Payment transactions are processed securely through encrypted Shopify checkout environments. Accepted payment modalities include Visa, Mastercard, American Express, Apple Pay, Google Pay, Diners Club, Discover, and JCB. Full cardholder numbers are never retained on our internal servers.

5.3 Fulfillment Mechanics: Order confirmations generated over email do not signal legal acceptance of an order. Contractual acceptance occurs strictly when the product is formally dispatched and a shipping confirmation notification is transmitted. Order modifications or cancellations are only permitted within 24 hours of placement and provided dispatch has not materialized.

5.4 Return Policies & Hygiene Rules: Unused and completely unopened items in original packaging may be returned within 14 days of receipt for a full product refund. However, due to strict health, sanitation, and hygiene mandates, opened or used oral care products (including all toothbrush heads and intraoral hardware) are fundamentally excluded from return or exchange unless verified as structurally defective upon arrival. Defective or shipping-damaged products must be brought to our attention within 7 days of receipt at info@agenticdental.com with photographic proof to qualify for a complimentary replacement or refund.

6. Mobile Application & Hardware Integration Terms (App Specific)

6.1 App Store Terms: The App is distributed via the Apple App Store and Google Play Store. Your utilization of the software is concurrently bound by platform-specific distribution terms. Apple Inc. and Google LLC are not operational parties to these Terms, carry no maintenance or support obligations, and hold no liability for product claims, intellectual property disputes, or data breach actions.

6.2 Technical Network Syncing: The LumaBrush hardware device communicates with the App over a direct local Wi-Fi link. The user is entirely responsible for ensuring correct network configurations, router firewall adjustments, and local device permissions. We hold no liability for syncing failures induced by local router variations.

6.3 Device Firmware Updates: We periodically push over-the-air firmware upgrades to optimize hardware utility. Certain high-tier features inside the App may mandate a minimum firmware tier. We strongly recommend immediate installation of all firmware updates; we decline liability for degraded software operational performance stemming from outdated hardware firmware.

6.4 Sensitive Camera Permissions: The App requires hardware camera access permissions to extract and process the live intraoral video feed. By launching an oral scan, you explicitly authorize the capture, transmission, and cloud-based algorithmic evaluation of this sensitive information for dental health reporting. You retain the right to command the absolute deletion of your historical scan media files at any time via email to info@agenticdental.com.

7. Acceptable Use Policy

You pledge to utilize our Website, physical Device, and App software only for their designated and lawful purpose—monitoring your personal oral condition or that of a minor under your direct custody. You are stringently prohibited from:

• Capturing or processing biometric, image, or health indicators of any individual without their explicit, informed, and written consent.

• Reversing engineering, decompiling, extracting source code, or copying the underlying AI models and visual structural tracking frameworks of Luma Brush.

• Damaging, overloading, or short-circuiting our cloud server architecture, or bypassing security access control systems.

8. Warranty Framework & Intellectual Property

8.1 Hardware Warranty: All Luma Brush smart toothbrush hardware units are protected by a 12-month limited warranty from the date of purchase against structural manufacturing defects. This warranty is voided in instances of user modification, accidental impacts, moisture ingress outside parameters, normal structural wear and tear, or standard degradation of consumable components like brush heads.

8.2 Intellectual Property: All application assets, software code, user interface architecture, artificial intelligence inference logic, report design configurations, dental mapping technology, graphics, and brand trademarks are exclusively owned by or licensed to Luma Brush Medical Equipment Trading LLC. No explicit or implied ownership rights are transferred under these Terms.

9. Limitation of Liability

TO THE MAXIMUM EXTENT SANCTIONED BY UAE FEDERAL LAW AND MANDATORY LOCAL CONSUMER JURISDICTIONS:

• LUMA BRUSH MEDICAL EQUIPMENT TRADING LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING PLATFORM AVAILABILITY OR AI REPORT ACCURACY. THE SERVICE IS DISTRIBUTED 'AS IS'.

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, REVENUE LOSS, OR PERSONAL HEALTH CONDITIONS MISSED STEMMING FROM THE USE OF THE HARDWARE OR RELIANCE ON APP DIAGNOSTICS.

• OUR COMPREHENSIVE, AGGREGATE FINANCIAL LIABILITY FOR ANY BREACH, INDEMNITY, OR ACTION COUPLING THESE TERMS IS STRICTLY CAPPED AT THE EXACT MONETARY AMOUNT PAID BY YOU FOR THE RELEVANT LUMA BRUSH HARDWARE UNIT OR RUNNING SOFTWARE SUBSCRIPTION IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM FORMULATION.

10. Governing Law & Dispute Resolution

These Terms and all operational cross-platform relations are governed by and construed under the laws of the United Arab Emirates, specifically the Emirate of Abu Dhabi. Any conflict, disagreement, or claim arising out of these terms shall first be subject to good-faith mutual negotiations for a window of 30 days. If unresolved, the dispute shall be submitted to the exclusive jurisdiction of the competent courts of Abu Dhabi, United Arab Emirates.

International Mandate Exception: Customers residing within the European Union (EU), United Kingdom (UK), or alternative regions with non-waivable statutory consumer frameworks retain the benefit of all local consumer protection provisions which cannot be contractually overridden.
